ATTORNEY’S FEE RULES

The attorney’s fee is agreed upon during the initial meeting with the client. In our Law Office we apply either a flat fee or hourly rate fee system. The amount of the fee depends on:

type of the case – complexity of proceedings, probable number of court appearances; value of the subject matter of the case or the value of the recovered claim in the case of proceedings at the enforcement stage;
workload.

It is possible to conclude a contract that applies the success fee settlement. This means that the client pays a fixed fee for the preparation of the case (the amount that covers the costs), and if he/she wins a pecuniary claim – the lawyer receives a fixed percentage bonus. To comply with the rules of professional ethics, the maximum percentage rate is 30% of the subject of the dispute.

LEGAL ADVICE

The cost of legal advice is usually also agreed in advance and depends on the complexity of the legal issue – the actual state of the case with which a client comes to us.

Currently, the attorney’s fee for providing legal advice ranges from PLN 123 to 246 (including VAT – currently 23%). If the client comes to us with several issues – the fees add up.

In the case the client commissions the lawyer to handle his/her case, the paid costs of legal advice are included in the fee for handling the case.

PLEADINGS AND CONTRACTS

The cost of preparing a pleading (e.g. application, petition, appeal and other pleadings) is usually agreed in advance as a flat fee. This kind of services depend on the complexity of the case and the

date when the client expects the pleading to be prepared.

COURT CASES

The amount of the attorney’s fees is determined in a contract with the client, and while it is difficult to determine the suggested fee for all kinds of cases in advance – the Regulation of the Minister of Justice of 28 September, 2002 on fees for advocate’s activities and the costs of free of unpaid pro bono legal aid incurred by the State Treasury (Dz.U.02.163.1348) can be regarded as reliable references.

The minimum rates in civil cases in correspondence to the value of the subject matter are: 1) up to PLN 500 – PLN 120;
2) PLN 500 to PLN 1,500 – PLN 360;

3) PLN 1,500 to PLN 5,000 – PLN 1,200;

4) PLN 5,000 to PLN 10,000 – PLN 2,400;

5) PLN 10,000 to PLN 50,000 – PLN 4,800;

6) PLN 50,000 to PLN 200,000 – PLN 7,200;

7) over PLN 200,000 – PLN 14,400.
